Privacy and Consent Agreement – Auto Loans Direct
In this Agreement, the terms “we,” “our,” and “us” refer to Auto Loans Direct and any of its affiliated members. “You” and “your” refer to the individual applying for, using, or guaranteeing any of our personal or commercial credit products or services (collectively referred to as the “Services”), including any co-applicants, guarantors, or personal representatives.
Collection, Use, and Disclosure of Personal Information
When you apply for, use, or guarantee any of our Services, or during the time you are a customer of Auto Loans Direct, you agree that we may collect, use, and share personal information for the purposes outlined in this agreement.
We may gather personal details such as:
- Your full name, address, occupation, and date of birth (as legally required);
- Proof of identity, including a valid Canadian driver’s license, passport, or birth certificate. We may also request a recent utility bill to confirm your address;
- Your financial background, including income, assets, liabilities, and credit history;
- Details of your interactions with us, including payment history and account activity.
We collect, use, and disclose this information to:
- Verify your identity;
- Understand your financial situation and needs;
- Determine your eligibility and suitability for our Services;
- Offer and manage Services tailored to you;
- Provide you with ongoing support and account servicing;
- Comply with legal and regulatory obligations;
- Investigate and process insurance claims;
- Detect and prevent fraud or other unlawful activity.
We may use health information strictly for insurance-related purposes and only with your explicit consent.
Third-Party Services and Data Handling
Auto Loans Direct may work with trusted third-party service providers to deliver specific services such as administrative processing, marketing, and mailing services. These providers are contractually obligated to protect your personal information in accordance with our privacy policies.
We do not sell your personal information.
If needed to complete your credit application or facilitate a vehicle purchase, we may share your information with external lenders or financial institutions. In such cases, you may become a customer of that institution and should review their privacy practices independently.
Your Social Insurance Number (SIN) may be collected where required for income tax reporting. With your permission, we may also use it to help verify your identity or maintain accurate records with credit bureaus. You may decline to share your SIN for optional purposes.
Communication and Call Monitoring
Phone conversations between you and Auto Loans Direct may be recorded or monitored. This helps us verify instructions, ensure service quality, and maintain accurate records. You will typically be notified at the start of the call.
Credit Reporting and Loan Services
When you apply for, accept, or guarantee a loan, line of credit, or other credit facility through Auto Loans Direct, we may collect, verify, and share your information with:
- Credit bureaus
- Insurance providers (including creditor and mortgage insurers)
- Financial registries
- Affiliates and other institutions you may have financial relationships with
- Any other party as legally required or permitted
This sharing may continue throughout the duration of your credit agreement and even after it ends in order to help maintain the accuracy of credit reporting systems.
Once you’ve entered into a credit agreement with us, you cannot withdraw your consent for data collection and reporting related to that credit until the account is fully satisfied. Credit reporting may continue after closure of the account.
Legal Obligations and Data Retention
We may share personal information with law enforcement or government agencies when required by law or if necessary to protect our business, customers, or the public.
Your personal information will be retained only as long as needed to fulfill the purposes outlined in this agreement—even after your relationship with us ends.
Refusing or Withdrawing Consent
Subject to legal or contractual restrictions, you may refuse or withdraw your consent to our collection, use, or disclosure of your information at any time by providing reasonable notice.
Please note that withdrawing consent may limit our ability to provide some Services to you.
You can also ask us not to use your information for promotional purposes.
